These Terms of Use govern your use of Bendout (the "App"), an arrow puzzle game published by TuranliApp (İsmail Turanlı, "we", "us"). The App is licensed to you under Apple's Standard EULA; these Terms add the rules for the game, its ads and its in-app purchases. Our general Terms of Use for other TuranliApp apps do not apply to Bendout. By using the App you agree to these Terms. If you do not agree, do not use the App.
Bendout is free to play. It shows ads and offers optional in-app purchases. Levels, rewards, prices and offers may differ between versions and regions. If you are under 18, play only with a parent's or guardian's permission, including for any purchase. The App is not directed at children under 13.
Gold, lives, boosters (such as Hint, Shield and Smash) and stars ("game items") are part of the game. You get a licence to use them in Bendout; you do not own them. They cannot be exchanged for money or for anything outside the game, and cannot be transferred, sold or traded. Using a game item uses it up. Lives refill over time as shown in the App. This does not affect your rights described in section 3 if a purchase was faulty or you end the contract lawfully.
Your progress and game items are saved on your device and backed up to your iCloud account, if iCloud is on. If you delete the App, change device or turn off iCloud, game items that are not in that backup cannot be restored, by us or by Apple. Settings › Restore purchases brings back "No ads", including the "No ads" in the starter pack, on the same Apple Account. Gold, lives and boosters from purchases, including the starter pack's, are added once and come back only through your iCloud backup.
What each purchase includes and its price are shown in the App before you buy. Gold packs and the life line are consumable: their contents are added once and are used up as you play. "No ads" and the starter pack are one-time purchases: "No ads" turns off the ads that appear between levels for as long as you use the App with the same Apple Account; rewarded ads that you choose to watch for a reward remain available. The starter pack includes "No ads" and the game items shown in the offer.
Payment is charged to your Apple Account when you confirm the purchase. Apple sells in-app purchases and handles payments, refunds and, in the EU, your right of withdrawal under the Apple Media Services Terms. You have the statutory rights for faulty digital content and services. If a purchase does not arrive, use Restore purchases for "No ads", or email us your Apple receipt and we will make sure you receive what you paid for. Corrections under section 5 never remove items you paid for.
Ads are provided by Google AdMob. The ads and the products they promote are the responsibility of their advertisers, not ours. A rewarded ad gives its reward only if you watch it to the end, and an ad may not always be available. How ads use information is explained in the Bendout Privacy Policy.
Do not use the App unlawfully, cheat, modify the App or its saved data, exploit bugs, use bots or scripts, get around its ads, limits or purchases, resell it, or reverse engineer it except where the law allows. If game items that you did not pay for are added by mistake, through a bug or by cheating, we may remove them.
We may make minor changes to the game to fix bugs, keep it fair or follow the law, and we may add levels and features. We will not reduce what you get for paid items or for gold you bought. If a change would affect your purchases more than in a minor way, we will tell you in an App update or on this page at least 30 days before it takes effect; you may then end the contract, free of charge, and get a refund for the part you have not used.
Nothing in these Terms limits the rights you have by law as a consumer, including the statutory guarantee for the App and your purchases.
We are fully liable for damage we cause intentionally or through gross negligence, for injury to life, body or health, and wherever the law does not allow liability to be limited. For slight negligence we are not liable for lost profits or indirect damage.
If you live outside the EU, the EEA, the UK and Switzerland, our total liability, other than where we are fully liable as described above, is limited to the greater of what you paid for the App's purchases in the last twelve months or USD 100.
These Terms are between you and us, not Apple. Apple is not responsible for the App, its content or its support; we are, including for any claim about the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm that you are not in a country under a U.S. Government embargo or on a U.S. Government list of restricted parties.
These Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the mandatory protection of the law of the country where you live, and you may bring a claim in its courts. If something goes wrong, please write to us first so we can try to help. We are not obliged and not willing to take part in dispute resolution before a consumer arbitration board.
We may update these Terms when the App, the law or our providers change, and will publish the new version on this page with a new date. A change that disadvantages you will be announced at least 30 days ahead in an App update or on this page; it never applies to a claim that arose before it, and if you do not agree, you may stop using the App and end the contract as described in section 5. If a part of these Terms is invalid, the rest stays in force.
