Terms of Use - Koza

These Terms of Use (this "Agreement") govern your use of Koza (the "App"), a pregnancy tracking application for iOS published by TuranliApp ("we", "us"). Please read them before using the App.

This Agreement covers Koza only. TuranliApp publishes other applications with different features, which are covered by our general Terms of Use. Where the two differ, this document governs your use of Koza.

By downloading, installing, or using Koza, you agree to be bound by this Agreement. If you do not agree, do not use the App.

1. RELATIONSHIP WITH APPLE

This Agreement is between you and TuranliApp only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.

Koza is licensed to you, not sold. Your licence to download and use the App is granted under Apple's Licensed Application End User License Agreement (the "Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. This Agreement sets out the additional terms that apply to your use of Koza's features and services.

Apple has no obligation to furnish any maintenance or support services for the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal requirements, and claims arising under consumer protection or similar legislation.
We, not Apple, are responsible for the investigation, defense, settlement, and discharge of any third-party claim that the App infringes intellectual property rights.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance, will have the right to enforce it against you.

2. WHO CAN USE KOZA

Koza is intended for adults. You must be of legal age in your jurisdiction to enter into this Agreement, and in any event at least 16 years old, to use the App. Anyone under 13 may not use the App under any circumstances.

The App does not verify your age. We rely on the statement you make by accepting this Agreement. If we become aware that an account belongs to someone below the applicable age, we will delete it and its data.

If you are a minor permitted to use the App under the law of your country, you must have the consent and supervision of a parent or guardian, who must read and agree to this Agreement on your behalf.

3. WHAT KOZA IS, AND WHAT IT IS NOT

Koza is an informational and record-keeping tool for tracking a pregnancy. It lets you record measurements, appointments, symptoms, photos, and notes, follow week-by-week information about pregnancy, and share a pregnancy with family members you invite.

KOZA IS NOT A MEDICAL DEVICE. IT DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

Pregnancy weeks, due dates, and fetal size and weight figures shown in the App are general estimates derived from the dates you enter. They are not a clinical assessment of your pregnancy.
Articles, tips, and answers from the in-App assistant are general information. They are not tailored to you, your medical history, or your circumstances. Assistant answers in particular are generated by artificial intelligence and are not reviewed by a healthcare professional - see Section 4.1.
Reminders and notifications are conveniences, not a clinical monitoring service. Do not rely on the App to alert you to a medical problem.

Always consult your physician or midwife with any question about your pregnancy or your health. Never disregard or delay professional medical advice because of something shown in the App. If you believe you may have a medical emergency, contact your local emergency service immediately. Do not use the App to seek help in an emergency.

4. THE IN-APP ASSISTANT

The App includes an assistant where you can ask general questions about pregnancy. The text you type is sent over an encrypted connection to AIProxy (aiproxy.com), which forwards it to our AI provider, OpenAI, L.L.C., in order to generate a reply. Both are located in the United States. Section 6 of the Privacy Policy describes this path, and what each provider records, in detail.

Two things happen without any request being sent. If what you write matches a list of urgent pregnancy symptoms built into the App, the App answers from that built-in list and tells you to contact your doctor or emergency services; no request leaves your device. If the connection or the AI provider fails, the App answers from a fixed set of answers stored inside the App.

Only the text you type is sent. The assistant has no access to your records, and none of your tracked data - your dates, measurements, symptoms, appointments, letters, journal entries, or photos - is transmitted with it. Our Privacy Policy sets this out in detail. Because only what you type is sent, you decide how much leaves your device, and you should not type personal or identifying details into it.

4.1 Answers are AI-generated, and we take no responsibility for them

Answers from the assistant are produced by artificial intelligence. They are not written by us, and not written or reviewed by a healthcare professional. They are generated automatically by a language model. They are not authored, checked, verified, approved, or endorsed by TuranliApp, and they are not reviewed by any physician, midwife, nurse, or other qualified professional before you see them.

Language models can produce statements that are inaccurate, incomplete, outdated, internally inconsistent, or entirely fabricated, and they can do so in a confident tone that gives no indication anything is wrong. We make no representation or warranty of any kind as to the accuracy, reliability, completeness, safety, or suitability of any answer, for any purpose.

You use the assistant, and act on anything it tells you, entirely at your own risk. To the maximum extent permitted by applicable law, TuranliApp accepts no responsibility and no liability for anything you do, or do not do, on the basis of an answer from the assistant, including any consequence for your health, your pregnancy, or your baby.

The assistant is not a substitute for professional care. If an answer conflicts with guidance from your physician or midwife, follow your physician or midwife. Section 3 applies to the assistant in full: it does not provide medical advice, diagnosis, or treatment, and you must not rely on it for any decision about your health, your pregnancy, or your baby.

4.2 Your obligations

You agree not to submit another person's personal information to the assistant, and not to use it to attempt to obtain a diagnosis, a prescription, or emergency assistance. In an emergency, contact your local emergency service.

5. APPLE HEALTH

If you enable it, Koza can write weight, water, blood pressure, and blood glucose to Apple Health, and read step count and weight from it. This exchange is optional, is off until you enable it, and can be revoked at any time in the iOS Health app. Data obtained from Apple Health is used only to display information to you inside the App. You are responsible for the accuracy of the values you enter.

6. YOUR ACCOUNT

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate information and to keep it current.
You may delete your account at any time from Profile > Delete My Account. This permanently erases your account and the associated data described in our Privacy Policy, and cannot be undone.
We may suspend or terminate an account that violates this Agreement.

7. SHARING A PREGNANCY WITH FAMILY

Koza lets you invite other people, such as your partner, to a pregnancy by giving them an invite code you generate in the App.

You control who gets the code, and the code grants access. Anyone who joins with it becomes a member of that pregnancy and can read and write its shared information, including your weight entries, blood pressure values recorded with them, kick history, appointments, and letters. Share the code only with people you intend to give this access to.

You are responsible for the invitations you issue. If you invite someone in error, or no longer wish to share, contact us at the address in Section 16. We are not responsible for what a family member you invited does with information they can legitimately see.

8. YOUR CONTENT

Photos, letters, notes, journal entries, and measurements you create in the App are yours. You retain all rights to them.

You grant us only the limited licence necessary to operate the App for you: to store your content, transmit it between your devices and the family members you have invited, and display it back to you. We do not use your content for advertising, do not sell it, and do not use it to train machine learning models.

You are responsible for your content, and you confirm that you have the right to upload anything you add to the App.

9. PROHIBITED BEHAVIOR

You agree not to:

Use the App for any unlawful purpose, or in violation of this Agreement.
Attempt to gain unauthorized access to the App, other users' accounts, or our systems, including by guessing or enumerating invite codes.
Upload content that is unlawful, or that infringes the rights of others.
Upload another person's health information without their consent.
Reverse engineer, decompile, or attempt to derive the source code of the App, except to the extent this restriction is prohibited by applicable law.
Interfere with or disrupt the App or the servers on which it relies.
Resell, sublicense, or commercially exploit the App or its content.

10. PRICING AND PURCHASES

Koza can be used free of charge. The App also offers an optional premium subscription, which raises the daily limits on the in-App assistant and unlocks additional features. What the free tier includes and what the subscription adds is shown in the App before you purchase.

10.1 Subscription terms

Durations offered: monthly, three-monthly, and yearly.
Price: shown in the App in your local currency before you confirm. Prices are set per App Store region and may change; a change never applies to a period you have already paid for.
Auto-renewal: subscriptions renew automatically at the end of each period unless you cancel. Your Apple account is charged for the renewal within 24 hours before the current period ends.
Cancelling: you can cancel at any time in your Apple account settings (Settings > your name > Subscriptions on iOS). Cancellation takes effect at the end of the current period; the subscription remains active until then. Deleting the App does not cancel a subscription.
Free trial: where a free trial is offered to you, its length and what happens at the end of it are shown in the App before you start. If you buy a subscription while a trial is running, any unused part of the trial is forfeited, as required by the App Store.
Restoring: a subscription is tied to your Apple account. If you reinstall the App or use another device, use "Restore Purchases" in the App.

10.2 Payment and refunds

All purchases are processed by Apple under the App Store's terms, and are subject to Apple's Media Services Terms and Conditions. We do not receive or store your payment details, and we cannot see your card. We cannot issue refunds. Refund requests are handled by Apple; you can request one at reportaproblem.apple.com. Except where the law of your country gives you a right of withdrawal or a statutory refund right, payments are otherwise non-refundable, including for periods you did not use.

If the premium features are not available in the version of the App you are using, no purchase is offered and nothing in this section applies to you.

11. AVAILABILITY, CHANGES, AND ACCURACY

We may modify, suspend, or discontinue the App or any of its features at any time.
The App depends on your device, your internet connection, and third-party infrastructure. We do not warrant that it will be available without interruption or free of errors.
Information displayed in the App, including pregnancy weeks and reference material, may contain inaccuracies or become out of date.
You are responsible for your own backups. Data held only on your device is not recoverable by us if your device is lost, reset, or the App is deleted.

12. PRIVACY

Our handling of your information is described in the Koza Privacy Policy, which forms part of this Agreement. Please read it: it explains, in particular, which information stays on your device and which is stored in the cloud.

13. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY INFORMATION IT PRESENTS IS ACCURATE OR COMPLETE.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURANLIAPP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

WITHOUT LIMITING THE FOREGOING, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY LOSS, INJURY, ILLNESS, OR DAMAGE ARISING FROM YOUR RELIANCE ON AN ANSWER PRODUCED BY THE IN-APP ASSISTANT, OR ON ANY OTHER INFORMATION PRESENTED IN THE APP, INCLUDING PREGNANCY WEEK CALCULATIONS, DUE DATE ESTIMATES, FETAL SIZE AND WEIGHT FIGURES, ARTICLES, AND REMINDERS.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR TWENTY-FIVE UNITED STATES DOLLARS (USD 25).

Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

15. GOVERNING LAW AND DISPUTES

This Agreement is governed by the laws of the State of Florida, United States of America, without regard to its conflict of law principles, and disputes are subject to the exclusive jurisdiction of the state and federal courts located in Florida.

Nothing in this Section deprives you of the mandatory consumer protections available to you under the law of your country of residence, or of your right to bring proceedings before the courts of that country where the law grants you that right. For users resident in Turkey, this includes rights under Law No. 6502 on Consumer Protection, and the right to apply to the consumer arbitration committees and consumer courts.

Before starting formal proceedings, both parties agree to send written notice of the dispute to the other and to attempt in good faith to resolve it informally within 60 days.

16. TERMINATION

You may end this Agreement at any time by deleting your account and removing the App from your devices. We may suspend or terminate your access if you materially breach this Agreement. Sections 8, 13, 14, 15, and 17 survive termination.

17. GENERAL

If any provision of this Agreement is held unenforceable, the remaining provisions remain in full force.
Our failure to enforce a provision is not a waiver of it.
You may not assign this Agreement; we may assign it in connection with a merger, acquisition, or sale of assets.
This Agreement, together with the Privacy Policy, is the entire agreement between you and us regarding Koza.

18. CHANGES TO THIS AGREEMENT

We may update this Agreement to reflect changes in the App or in applicable law. We will revise the "Last Updated" date above, and for material changes we will notify you in the App or by email where appropriate. Continuing to use the App after a change means you accept the updated Agreement.
