These Terms of Use govern your use of Florecho: Plant Identifier (the "App"), published by TuranliApp (İsmail Turanlı, "we", "us"). The App is licensed to you under Apple's Standard EULA; these Terms add the rules for the App's features. Our general Terms of Use for other TuranliApp apps do not apply to Florecho. The App asks you to accept these Terms before your first AI request. If you do not agree, do not use the App.
Important. Florecho's results come from artificial intelligence and can be wrong, even when they sound certain. They are not professional, medical or veterinary advice. Never decide that a plant, berry or mushroom is safe to eat, touch or give to a person or animal because of Florecho. If someone may have swallowed or touched something harmful, contact emergency services (such as 112 or 911), a poison center, a doctor or a vet immediately.
The App uses an AI model run by a third party to suggest what a plant, tree, weed, insect or bird may be, to describe what a photo shows, and to answer short questions about a result. Results, confidence levels, watering ranges, reminder dates and light readings are estimates. They can be incomplete or wrong, and no person checks them before you see them. Reminders can be delayed or missed by iOS. Check anything important with a qualified person before acting on it.
If you are under 18, use the App only with a parent's or guardian's permission. The App is not directed at children under 13.
Florecho does not diagnose or treat people or animals. It is designed never to recommend a medicine, a dose or a remedy, never to tell you that a plant is edible or safe, and to decline questions about symptoms, poisoning or treatment. Because it is AI, it can still get this wrong: if an answer ever seems to give such advice, do not follow it.
No warning does not mean safe: if the AI misidentifies a plant, a real hazard may be missing. Keep children and animals away from an unfamiliar plant until a qualified person has identified it. The App is not designed to identify mushrooms and cannot tell whether a tree is safe or likely to fall.
You keep all rights in your photos, notes and questions. When you start a scan or ask a question, you allow us and the providers named in the Privacy Policy to process it to give you the result and to keep the service secure. We do not sell your photos or use them to train AI models. Photograph only what you want identified, and do not type personal or health information into a question. My Garden is stored only on your device, so we cannot restore it.
AI features need an internet connection and have daily limits for every user, subscribers included, and they may sometimes be unavailable. Do not use the App unlawfully, get around its limits or safety features, use bots or scripts, resell it or its AI features, or reverse engineer it except where the law allows. We may block AI features for a device that does. We may change the App for valid reasons, such as costs, abuse or the law, and will tell you in the App before a change that significantly reduces what you can do.
Florecho can be used for free. Some features may be offered as an auto-renewing subscription; what it includes, its price and any free trial are shown in the App before you buy. Payment is charged to your Apple Account when you confirm the purchase. A subscription, including one that starts with a free trial, renews automatically unless you turn it off in your App Store account settings at least 24 hours before the current period ends. After you cancel, you keep access until the end of the period you paid for. Apple handles payments, refunds and, where it applies, the right of withdrawal under its terms. If a price changes, Apple tells you in advance and asks for your consent where required.
Nothing in these Terms limits the rights you have by law as a consumer.
We are fully liable for damage we cause intentionally or through gross negligence, for injury to life, body or health, and wherever the law does not allow liability to be limited. For an ordinary mistake (slight negligence), we are liable only if we breach an obligation that is essential to the App working as agreed, and then only for typical, foreseeable damage. Otherwise the App is provided "as is". If you ignore the warnings in these Terms, that may reduce our liability under the ordinary rules on shared fault.
If you live outside the EU, the EEA, the UK, Switzerland and Turkey, our total liability, other than where we are fully liable as described above, is limited to the greater of what you paid us for the App in the last twelve months or USD 100.
These Terms are between you and us, not Apple. Apple is not responsible for the App, its content or its support; we are, including for any claim about the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm that you are not in a country under a U.S. Government embargo or on a U.S. Government list of restricted parties.
These Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the mandatory protection of the law of the country where you live, and you may bring a claim in its courts. If something goes wrong, please write to us first so we can try to help.
We may update these Terms when the App, the law or our providers change. A change that disadvantages you applies only after the App has shown it to you and you have accepted it, and never to a claim that arose before it. If a part of these Terms is invalid, the rest stays in force.
