Terms of Use and End User License Agreement - Safa

Welcome to Safa. These Terms of Use and End User License Agreement (collectively, the "Agreement") govern your access to and use of the Safa mobile application (the "App"). Safa is operated by Ismail Turanli ("we," "us," or "our"). You can contact us at ismailturanli91@gmail.com.

Please read this Agreement carefully before downloading, installing, or using the App. By downloading, installing, accessing, or using Safa, you confirm that you have read, understood, and agree to be bound by this Agreement.

If you do not agree to this Agreement, you must not access, download, install, or use the App. If you have already installed the App and do not agree, you must delete it from your devices.

I. App Information

Safa is an Islamic companion app designed to help users organize daily worship and access practical Muslim tools. Features may include prayer times, Qibla direction, Quran reading progress, dhikr tools, Ramadan guidance, Jumuah preparation, Yasin Sharif, Asma ul Husna, prayer guidance, nearby mosque information, and thoughtful AI-assisted prompts.

II. Changes to This Agreement

We may modify this Agreement at any time. If we make changes, we may update this page, post the revised version in the App, or otherwise provide notice where appropriate. Your continued use of the App after changes become effective means you accept the revised Agreement.

III. Eligibility and Age Requirements

You must be legally able to enter into this Agreement in your jurisdiction. If you are under the age of majority, you may use the App only with the consent and supervision of a parent or legal guardian.

The App is not intended for children under 13. By using the App, you represent that you meet the age and consent requirements applicable in your jurisdiction.

IV. License to Use the App

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App for your personal, non-commercial use on Apple-branded devices that you own or control, as permitted by Apple App Store rules.

You may not copy, modify, reverse engineer, decompile, disassemble, distribute, sell, rent, lease, sublicense, or create derivative works from the App, except to the extent such restriction is prohibited by applicable law.

V. Important Religious and Location Information Disclaimer

Safa is provided as a practical digital tool. Prayer times, Qibla direction, Hijri dates, Ramadan information, mosque information, and other Islamic guidance may depend on calculation methods, your device settings, GPS/location accuracy, network availability, third-party data sources, and regional religious practices.

We do not guarantee that prayer times, Qibla direction, Hijri dates, mosque listings, or other religious information will always be complete, accurate, current, or suitable for every location, madhhab, local authority, or community practice.

You are responsible for verifying religious times, directions, rulings, and practices with trusted local scholars, mosques, Islamic authorities, or other reliable sources where accuracy is important.

VI. AI-Assisted Guidance

The App may include AI-assisted prompts or guidance features intended to support reflection and learning. AI-generated responses may be incomplete, inaccurate, or unsuitable for your circumstances.

AI-assisted content is not a fatwa, religious ruling, legal advice, medical advice, financial advice, or professional counseling. You should consult qualified scholars or professionals for personal, religious, legal, medical, or other important decisions.

VII. Privacy

Your privacy is important to us. Safa may request access to certain device features, such as location, notifications, or network access, to provide features such as prayer times, Qibla direction, nearby mosque information, reminders, and app functionality.

Any collection or processing of personal data is described in our Privacy Policy, which is incorporated into this Agreement by reference. If you do not agree with the Privacy Policy, you must stop using the App.

The Privacy Policy may be made available in the App, on our website, or through the App Store listing.

VIII. User Responsibilities and Prohibited Conduct

You agree to use the App only for lawful purposes and in accordance with this Agreement. You must not:

Use the App in any unlawful, harmful, fraudulent, abusive, or unauthorized way
Interfere with or disrupt the App, servers, networks, or security systems
Attempt to gain unauthorized access to any systems, accounts, data, or services
Use bots, scripts, scraping, automation, or other abusive methods to access the App
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
Use the App to harass, threaten, defame, impersonate, or harm others
Use AI-assisted features to generate harmful, misleading, hateful, violent, illegal, or abusive content
Use the App in a way that violates third-party rights, including intellectual property, privacy, or publicity rights

IX. Third-Party Services

The App may rely on third-party services for functionality such as maps, location, analytics, crash reporting, subscription management, AI processing, App Store payments, or other technical infrastructure. These services may include Apple services, mapping/location providers, analytics tools, payment services, or AI service providers.

Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, content, policies, or practices of third-party services.

X. Subscriptions, In-App Purchases, and Payments

The App may be free to download and may offer paid features, subscriptions, or in-app purchases. All payments, billing, renewals, cancellations, and refunds are handled by Apple through the App Store.

If you purchase an auto-renewing subscription, it will automatically renew unless canceled at least 24 hours before the end of the current period. Your Apple ID account may be charged for renewal within 24 hours before the end of the current subscription period.

To manage or cancel a subscription:

Open Settings on your iOS device
Tap your name
Tap "Subscriptions"
Select the relevant subscription
Tap "Cancel Subscription"

Deleting the App does not cancel your subscription. Refund requests are handled by Apple and are subject to Apple's policies.

XI. Availability, Updates, and Changes

We do not guarantee that the App will always be available, uninterrupted, secure, or error-free. The App may be affected by device issues, operating system changes, location accuracy, network availability, third-party outages, maintenance, or other factors beyond our control.

We may update, modify, suspend, discontinue, remove, or limit any feature of the App at any time, with or without notice, subject to applicable law.

XII. Intellectual Property

The App, including its design, interface, text, graphics, software, features, trademarks, logos, and other content, is owned by us or our licensors and is protected by intellectual property and other laws.

You may not use our name, trademarks, branding, content, or other intellectual property without our prior written permission, except as permitted by law.

XIII. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, and uninterrupted operation.

We do not warrant that the App will meet your requirements, that any information displayed in the App will be accurate or complete, or that errors will be corrected.

XIV. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, business interruption, personal injury, emotional distress, or other damages arising from or related to your use of or inability to use the App.

Where liability cannot be excluded under applicable law, our total liability shall be limited to the maximum extent permitted by law.

XV. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, partners, service providers, and representatives from and against any claims, liabilities, damages, losses, and expenses arising from your use or misuse of the App, your violation of this Agreement, your violation of applicable law, or your violation of any third-party rights.

XVI. Apple Terms and Third-Party Beneficiary

Safa is distributed through the Apple App Store. Apps made available through the App Store are licensed, not sold, and Apple provides a Standard EULA unless a custom EULA applies. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce this Agreement against you as a third-party beneficiary where applicable.

Apple is not responsible for providing maintenance or support services for the App, except as required by applicable law.

XVII. Export and Legal Compliance

You agree to comply with all applicable laws and regulations when using the App, including data protection, consumer protection, intellectual property, export control, and sanctions laws.

You represent that you are not located in a country or region subject to applicable embargoes or sanctions and that you are not listed on any applicable restricted party list.

XVIII. Termination

We may suspend or terminate your access to the App if you violate this Agreement, misuse the App, create security or legal risks, fail to pay applicable fees, or if we discontinue the App or any feature.

You may stop using the App at any time by deleting it from your devices. If you have an active subscription, you must cancel it through your Apple App Store account settings.

XIX. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws applicable in the jurisdiction where we operate, without regard to conflict of law principles, except where consumer protection laws require another governing law or forum.

Before bringing a formal claim, you agree to contact us at ismailturanli91@gmail.com and attempt to resolve the dispute informally.

XX. Severability and Entire Agreement

If any provision of this Agreement is found to be invalid or unenforceable, that provision will be modified or removed to the minimum extent necessary, and the remaining provisions will remain in effect.

This Agreement, together with the Privacy Policy and any other referenced policies, constitutes the entire agreement between you and us regarding the App.
